Terms & Conditions
The terms that govern your use of this website and the free tools we offer on it.
Last updated 2026-06-29
1. About these terms
These Terms & Conditions govern your use of the AscendQ website at ascendq.ca (the "website") and the free tools we offer on it. By using the website you agree to these terms. If you do not agree, please do not use the website. Paid engagements for design, development, SEO, or other services are governed by a separate written proposal or contract, which takes precedence over these terms for that work.
2. Use of the website
You agree to use the website lawfully and not to:
- Attempt to gain unauthorized access to the website, its servers, or any connected systems.
- Probe, scan, or test the vulnerability of the website, or breach its security or authentication measures.
- Scrape, harvest, or collect data from the website at scale, or use it to build a competing dataset.
- Interfere with or disrupt the website, or impose an unreasonable load on our infrastructure.
- Submit false, misleading, or unlawful information, or another person’s information without their consent.
- Use the website to transmit malware, spam, or any harmful or unlawful content.
3. The free website analysis tool
We offer a free tool that analyzes a website URL using Google PageSpeed Insights and presents the results with our suggestions. By submitting a URL, you confirm you are authorized to request analysis of that website.
The scores and metrics are produced by Google, are estimates that vary between runs and conditions, and are provided "as is" for general information only. They are not a guarantee of performance, search ranking, security, or any outcome, and do not constitute professional advice for a specific decision. Any action you take based on the report is at your own risk.
4. Intellectual property
All content on this website — text, design, graphics, logos, the AscendQ brand, and code — is owned by AscendQ or its licensors and is protected by law. You may view and share links to our pages. You may not copy, reproduce, republish, or create derivative works from our content without our written permission.
5. Disclaimers
The website and its free tools are provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy, or uninterrupted availability. Information on the website is for general guidance and is not professional advice for your specific situation.
6. Limitation of liability
To the fullest extent permitted by law:
- We are not liable for any indirect, incidental, consequential, special, or punitive damages arising from your use of the website or its tools.
- We are not liable for decisions you make based on the free analysis report or any information on the website.
- Our total aggregate liability for any claim relating to the website or its free tools is limited to CAD $100.
Some jurisdictions do not allow certain limitations; in those jurisdictions our liability is limited to the maximum extent permitted by law. Nothing in these terms limits liability that cannot be limited by law.
7. Indemnification
You agree to indemnify and hold harmless AscendQ from any claim, loss, or expense (including reasonable legal fees) arising from your use of the website, your violation of these terms, or your violation of any law or third-party right.
8. Third-party links
The website may link to third-party sites and services we do not control. We are not responsible for their content, policies, or practices. Visiting them is at your own risk and subject to their terms.
9. Availability
We aim for high uptime but do not guarantee the website will be available, uninterrupted, or error-free. We may modify, suspend, or discontinue any part of the website or its free tools at any time without notice.
10. Governing law
These terms are governed by the laws of the Province of Newfoundland and Labrador and the federal laws of Canada applicable therein. Any dispute will be resolved in the courts of Newfoundland and Labrador, except where mandatory consumer-protection law in your place of residence gives you a different right.
11. Changes
We may update these terms from time to time. The current version always lives at this page, with the "last updated" date above. Your continued use of the website after a change constitutes acceptance of the updated terms.
